"Rocket Scientists of America Quarterly" reported that AB 26, by Assemblymember Carole Migden, would provide for the registration
of domestic partnerships with the Secretary of State.
Whoa, registering sorta like a real partnership with the Secretary of State? Why didn't I think of that. |

Regulated Sex
Marriage is the only known state sanctioned contract in which sex is allowed to be part of the contract. When two assholes marry, they consent to the state's regulation of their sexual activities (and the products of their sexual activities).
What is great about Relationship LLCs (i.e. LLC Law) is that sex is NOT part of the contract. Therefore there is no law and no reason for any law to regulate sex between two people who form LLCs. Sex is not what is being contracted for, sex cannot be what is contracted for and, as a result, there is no need for the state to enter into the business of regulating sex between partners. When partners form LLCs they are not declaring a sexual relationship either to themselves or to the public.
Now, in this perfect world (which I in my infinite wisdom have created), along comes the above mentioned bill in which it is proposed that the state of California create a domestic partners law to be regulated through its Secretary of State's office. The Secretary of State's Office is the office which is normally charged with administering partnerships, LLCs and Corporations (i.e. business entities).
Now, by placing domestic partners in this domain, Sex now becomes part of the contract. The Act defines Domestic Partners as two people who are intimate. As anyone with a _ucking brain would expect, the State of California now proposes to regulate the sexual activites of people who become partners through this proposed new act. See the following definitions from the act:
" 297. (a) Domestic partners are two adults who have chosen to share one another's lives in an intimate and committed relationship of mutual caring.
(b) A domestic partnership shall be established when all of the following requirements are met:
(1) Both persons have a common residence.
(2) Both persons agree to be jointly responsible for each other's basic living expenses during the domestic partnership. i.e. Liable to each other for living expenses
(3) Neither person is married or a member of another domesticpartnership. under LLC any number of people may contract, under this thing only two people may contract
(4) The two persons are not related by blood in a way which would prevent them from being married to each other in this state.
(5) Both persons are at least 18 years of age.
(6) Both file a Declaration of Domestic Partnership with the Secretary of State pursuant to this division.
(c) "Have a common residence" means that two people are cohabitants. It is not necessary that the legal right to possess the common residence be in both of their names. Two people are cohabitants even if one or both have additional residences. Domestic partners do not cease to be cohabitants if one leaves the common residence but intends to return.
(d) "Basic living expenses" means food and shelter. It also means any other cost, such as medical care, if some or all of the cost is paid as a benefit because a person is another person's domesticpartner.
(e) "Joint responsibility" means that each partner agrees to provide for the other partner's basic living expenses if the partner is unable to provide for herself or himself. Anyone to whom these expenses are owed may enforce this responsibility.
As indicated above, the "Rocket Science Community" has sent out a call to action to support this idiot act. They WANT state regulated sex. They want a bastardized version of LLC/Partnership law which limits their contract options.
