Larry E. Ribstein is one of the most respected (if not THE most respected) authors on Partnerships and Limited Liability Companies. It was a great honor to us that Mr. Ribstein has referred to our Relationship LLC ™ concept in the past in some of his publications.

It turns out that there was a big conference recently at Washington University essentially on "marriage, relationships and the law" titled For Love or Money Roundtable Conference.

We just found out from Mr. Ribstein's blog that he submitted a paper at this conference titled Incorporating the Hendricksons.

"My paper, which I plan to disseminate in the next couple of months, and which has the title of this blog post, discussed whether business association standard forms are appropriate for domestic relationships. Short answer: no. This follows my earlier work on choice of law for marriage, also discussed in Chapter 8 of The Law Market, and more directly domestic relationship standard forms. The paper also enables me to make some productive use of my television watching." Larry E. Ribstein, Idealog

The reference to "television watching" is a reference to the "theory" that the HBO television series Big Love is really a examination of Gay Marriage.

"The important question regarding this evolutionary process is the extent to which the social externalities of domestic relationships discussed above will inhibit interstate recognition of new standard forms. Most states and the federal government already have enacted “defense of marriage” statutes that attempt to preserve the privileged status of marriage over other types of domestic relationships. It is not clear whether and how long this rigidity can survive the demand for new standard forms to accommodate diverse relationships. Moreover,the demand for the new forms is weakened by the competing demands by gay groups for the social recognition conferred by marriage. Our comment responding to Larry Ribstein's post has been posted to his blog. Our comment is:

"What about NOT having the government as a party to personal sexual relationships AT ALL? When you present as a given that people can manage their personal and sexual relationhips without the government as a party THEN, the main functions a legally recognized entity has to provide for is to manage the ownership and transference of property and to provide for the welfare of children and other dependent parties.

Obviously, our theory is that the current LLC business structure is adequate for managing the ownership and transfer of property and for providing for the welfare of children.

Personal Associations should be just that PERSONAL, and not something the State should be a party to.
